When I stand in front of my office, I beleive I can see parts of Plymouth, St. Louis Park and Golden Valley. There are certainly parts of those cities which are closer to my office than some parts of Minnetonka. Chapter 7 is the kind of bankruptcy which is the usually first choice of individuals who are in serious financial difficulty. It is very well suited to consumer debts, but often works well for self-employed individuals and small businesses too. It is commonly called a "straight" bankruptcy, and is also often referred to as a "liquidation." The bankruptcy court appoints a trustee who reviews what assets the debtor has available for distribution to creditors. Those would be only the assets that the debtor is unable to claim as exempt. If some assets are available, the creditors are notified. Those who submit claim forms will be given their proportionate share of the available assets, but that is ordinarily all they are going to receive. Since this video was made the median income requirements which the video refers to have gone up several times, so those numbers in the video are out of date. Here in Minnesota, Wells Fargo is the worst. Typically if the bank or credit union is one or your creditors, you can expect that institution to seize your accounts as soon as they are notified of the bankruptcy. If this is not planned for it can result in quite a surprise - checks bouncing, a debit card that has stopped working, and the evaporation of money you thought you had. You should expect your bankruptcy attorney to coach and advise you as to how this is to be avoided. What I tell my clients is that if they have an account with a bank or credit union which they owe money to, that account should be closed well in advance of the filing of the bankruptcy case - whether it's a Chapter 7 bankruptcy or a Chapter 13 bankruptcy. If you don't close that account, the bank or credit union will claim a right of setoff against your money in the account, which is a fancy way of saying that they will seize the money. Once they seize the money you won't get it back - or at least usually won't. So the thing to do is to close all such accounts before you file your bankruptcy case. It takes planning of course. I'm not saying you should try to live without a checking account. All you need to do is open an account at a bank which is NOT one of your creditors, and get all your automatic deposits and automatic withdrawals up and running with the new account before we file your bankruptcy case. As with a lot of the things that need attention before your case is filed, this process can take a few weeks. I hate it when I get a call from somebody who figures that filing a bankruptcy is like doing a 1040EZ and it should only take a one hour meeting. In most cases this means that my clients have to bring four categories of stuff to the meeting of creditors: driver's license, social security card, most recent paystub and bank statements for all open accounts which include the balance on the day the case was filed. In addition, the non-DockLink trustees require that we email them a copy of the most recent tax return. The trustees that use DockLink want everything the non-DockLink trustees want, but for many of the documents they want it sooner. And they often want many additional items that we didn't have to provide before. For example, they tend to want copies of all automobile title certificates and valuation information for the vehicles. If there has been a recent divorce, they may want a copy of the divorce decree. One can never know for sure what to expect until the trustee actually creates a list of the things he or she wants, and there's not much that isn't fair game. When DockLink is involved in the case, the only things left to bring to the meeting of creditors often are the driver's licenses and the social security cards. Chapter 7 bankruptcy is commonly called a "liquidation," but the only assets that get liquidated - in other words seized by the bankruptcy trustee - are the non-exempt assets. Most of my clients can claim all of their assets as exempt, so that noting is liquidated at all. As a practical matter, thier debts disappear and they can keep all their assets. Those of my clients who don't keep all their assets still keep most of their assets, and I can usually advise my clients as to what assets are at risk prior to the filing. If the loss of assets is not acceptable, chapter 13 might be a better choice. But that's a subject of a different video. If you want to file a Chapter 7 Bankruptcy, it would be best if your income was at or below the median for the state in which you live. If you are substantially over the median income for your state, you probably only qualify for a Chapter 13 Bankruptcy. In this video I show and discuss a table showing the November 1, 2015 median income numbers by household size for the State of Minnesota. If you live somewhere else, this does not apply to you. This table of income numbers changes every six months, on or about the 1st of April and the 1st of November - or at least it usually changes on those dates. Some of the ads try to imply that Obama has a new program that they can sign you up for to eliminate your debt. OR they claim that "you have a right to settle your debt ..." Well, everybody has always had a right to settle their debt - if the creditor will agree to a settlement - which is always the problem of course. You should avoid any agency that is not in the state where you live. Also avoid any agency that has not been approved by the Justice Department for bankruptcy counseling. It would be best is you go with an agency that has been around since before the current recession. Many of them had sprung up to take advantage of vulnerable people in the current difficult times. The only two debt counseling agencies recommended by Dave Kelly are Lutheran Social Services and Family Means.
